The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. A man lodged a complaint with HomO, alleging that his supervisor and immediate superior had been standing talking to a few other employees out of earshot. They had been discussing marriage for homosexuals and, in this connection, the supervisor had said that he thought homosexuals were disgusting, repulsive and abnormal. It was well-known at his place of work that the man was homosexual. After this incident, the man took the supervisor on one side and told him that he did not like him talking in this manner about homosexuals, and said that he felt insulted, in view of the fact that he himself was homosexual. The superior said that he thought that the man’s reaction to this occurrence was exaggerated, that he held the views which he had expressed, and that he had a right to do so.

The employer denied a breach of Act on a Ban against Discrimination in Working Life on grounds of Sexual Orientation (1999:133), primarily because the supervisor had acted as a private individual and not as a representative of the employer. Following discussion of the matter, HomO reached a settlement with the employer. The settlement agreement resulted in financial compensation for the man and an undertaking by the employer to draw up a policy document to counter discrimination and harassment.
