The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. Cable-TV company – Unlawful discrimination

A woman lodged a complaint with HomO. The main points were as follows. She called a cable-TV company’s customer service unit on several occasions to order gay films on the company’s “pay-per-view” service, under which the customer orders a film for immediate viewing and is debited later. On each occasion, she was told that the company did not show porno films. She had thus been downgraded to a porno viewer, although this was not the case. She had also been asked about her sexual orientation and, on one occasion, the person she was talking to at customer service had replaced the receiver in the middle of the conversation. Her treatment by the cable TV company had made her feel deeply insulted and discriminated against. The cable-TV company had no gay films and, despite her repeated requests, had done nothing to change the programme content.

HomO told the woman that there were no legal means of influencing the company’s programme content, but that her treatment by the company might be indictable under criminal law in accordance with the principle of unlawful discrimination. HomO also instructed the woman to provide certain supplementary information which HomO considered was required to determine further handling of the case. She was informed, in this context, that the case might be resolved, even if supplementary information was not submitted within the specified period. Since no further response was received, HomO closed the case and decided that no additional action should be taken.
