The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. Swedish Migration Board – Residence permit

A man lodged a complaint with HomO via his legal representative. The main points were as follows. When it rejected his application for a residence permit, the Migration Board had clearly discriminated against a homosexual couple. The Board had not applied the law in the same way to homosexual and heterosexual couples, despite the fact that civil partnerships and marriage are regarded as equivalent under Swedish law.

HomO closed the case without taking further steps for the reasons stated below. Although HomO ‘s assignment to prevent discrimination on the grounds of sexual orientation in any area of society was extensive, the Ombudsman’s duties did not include reviewing decisions taken by the Migration Board in a specific, ongoing case – or for that matter decisions taken by any other public authority. HomO had, for some time, implemented regular training measures at the Migration Board to increase awareness on the part of the Board’s staff concerning the right to equal treatment irrespective of sexual orientation, the conditions faced by homosexuals and the special circumstances which may apply in cases involving homosexual persons.
