The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. Higher education students Media QX Örebro Gay Students (ÖGS) reported the Örebro university library to HomO for discrimination against persons with a homosexual or bisexual orientation due to the librarys unwillingness to provide access to the QX periodical in the same manner as other periodicals. ÖGS reacted to the fact that this periodical was only available if it was ordered from storage, in contrast with a number of other periodicals displayed in the librarys magazine shelves. As a result of an overall assessment of the information available in this case, HomO concluded that the librarys routines for QX could not be regarded as discrimination on the grounds of sexual orientation. In this connection, HomO took special note of the fact that, based on its purchasing policy, the library had not decided to subscribe to QX and that no request for a subscription of this nature had been submitted in accordance with the procedure prescribed in this policy document. In HomOs view, this procurement policy, as described in the case, could not be regarded, per se, as discrimination against homosexual or bisexual persons.
