The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. Media company – Staff management

A man lodged a complaint with the Ombudsman. The main points were as follows. He was employed by a major company in the media industry. One night, after the close-down of broadcasting, his boyfriend came to fetch him. The man greeted his boyfriend by giving him a kiss, and then asked him to sit down and wait for a few minutes. Several colleagues saw this and reported it to the supervisor. The next day, the supervisor took the man on one side and proceeded, at some length, to express dissatisfaction about the fact that he had kissed his boyfriend during working hours. The man was convinced that this negative reaction on the supervisor’s part would not have occurred if a heterosexual couple had kissed each other under similar circumstances. As a result, he considered that he had been subjected to discrimination as a result of his homosexual orientation.

The man was represented in this dispute by his union (SIF) in negotiations with the employer at the local level. The employer confirmed that the supervisor had acted in the manner described, but refused to admit that the man had been subjected to discrimination due to his homosexual orientation. The two sides finally agreed that the employer was to pay the man a lump sum for “recreation purposes” and that all issues raised in the local negotiations had been settled.

The man stated that, notwithstanding the agreement reached with the employer, he did not want to withdraw his complaint to the Ombudsman since he was not satisfied with the agreement reached with the employer, but wished to have a formally review of the discrimination issue. In view of the agreement reached by the union and the employer on the man’s behalf, which the man had accepted, the Ombudsman concluded that was no basis for pursuing this case further.
