The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. ![]() (Including amendments: up to and including SFS 2006:892) A person who, in a disseminated statement or communication, threatens or expresses contempt for a national, ethnic or other such group of persons with allusion to race, colour, national or ethnic origin, religious belief or sexual orientation shall be convicted of incitement to hatred and sentenced to imprisonment for at most two years or, if the crime is petty, to a fine. If the crime is considered to be gross, the accused shall be sentenced to imprisonment for at least six months and at most four years. When assessing whether the offence is gross, particular consideration shall be given to whether the communication had a particularly threatening or insulting content and was disseminated to a large number of people in such a way that it was intended to attract significant attention. |
