The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. Employment – Recruitment – Heterosexual Orientation – Genuine
Occupational Requirement – Analogous SituationA self-identified heterosexual woman wanted to apply for a job with the Sweden national federation for lesbian, gay and transgender rights (RFSL) as safer sex information officer. However, she was told that the organisation was looking to hire a self-identified gay or bisexual man for the position, as it was applying a special peer-educational model for its information and behaviour adaptation outreach work. The woman made a discrimination complaint to the Ombudsman, who found that irrespective of whether you consider the sex or sexual orientation requirement for the job from the angle of ‘analogous situation’ or you try it under the exception from the direct discrimination prohibition for genuine and determining occupational requirements, the difference in treatment was legitimate and proportionate.
