The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. The previously existing acts against discrimination were also replaced with a new Discrimination Act. Some of the material on this website may therefore be out of date. Police – Prosecution Services – Incitement to Sexual Orientation Hatred

The Ombudsman against Discrimination on grounds of Sexual Orientation received a copy of a complaint made to the police about a web site on the Internet, its contents possibly being in violation of the criminal prohibition on incitement to sexual orientation hatred. The Ombudsman asked the police to be kept informed of the progress of their investigation. In spite of numerous reminders from the Ombudsman, almost three years later no action had been taken by the police officer in charge of the investigation. The Ombudsman noted that there was nothing further he could do within the limits of his mandate and therefore closed the file with critical observations about the police’s handling of the matter. The decision of the Ombudsman was also sent to the Parliamentary Ombudsmen for whatever action they found reason to take. The Parliamentary Ombudsman concluded that the police merited serious criticism (the next possible step would have been to prosecute the responsible police officer for his misconduct) for its negligence and closed the case with those very critical observations.
