The Ombudsman against Discrimination on grounds of Sexual Orientation has ceased to exist. On 1 January 2009 the Ombudsman was merged with the other Ombudsmen against discrimination into a new body: the Swedish Equality Ombudsman. Goods and services - health care – assisted procreation – different fees for heterosexual and lesbian couples

Acting on his own initiative, the Ombudsman initiated an investigation into the rules applied by one of Sweden’s county councils in providing health care in the form of assisted procreation to heterosexual and lesbian couples. The county council informed the Ombudsman that it charged lesbian couples a fee that was not levied from heterosexual couples, and that the reason for this distinction in treatment was that lesbian couples’ inability to have children together was not due to medical reasons. The county council did therefore not regard the provision of treatment in the form of assisted procreation to lesbian couples as falling within its obligation to provide healthcare. The Ombudsman found that lesbian and heterosexual couples in this context were in comparable situations, and that the county council’s practice of treating lesbian couples less favourably than heterosexual couples constituted discrimination on grounds of sexual orientation.
