Swedish Migration Board – Residence permit

A man lodged a complaint with the Ombudsman, stating that he had applied to the Swedish Migration Board for a residence permit seven months previously. Processing was supposed to take three months, but nothing had happened. He had been in hospital and was not feeling good.

The Ombudsman’s duty is to ensure that discrimination on the grounds of sexual discrimination should not occur in any area of society. The Ombudsman is not responsible, however, for reviewing the ongoing processing of a specific case by the Migration Board or any other public authority. In addition, there was nothing in the complaint to indicate that the processing period was related to the man’s sexual orientation.

The Ombudsman has implemented regular training measures in cooperation with the Migration Board to increase awareness on the part of the Board’s staff of the situation faced by homosexuals and the special circumstances which may apply in cases involving foreign citizens who are homosexual. The case was closed without further action by any public authority.
